Appeals Modernization Act: The VA's New Appeal System

There is a new procedure for filing appeals with the VA.  If you receive an initial rating decision after February 19th, 2019 it will fall under the Appeals Modernization Act (AMA). So, the VA now  has two separate systems for appeals AMA and Legacy. In some instances, you will be able to choose between the two systems. You will have to figure out which one is going to be the best for you if you have a choice.

There are all kinds of different considerations. If you have filed in the past, gotten denied, and didn't appeal, then you don't have a choice. You are stuck with AMA. Under AMA, there are new forms to file, so keep an eye out! So far, our experience has been that there is some confusion (even at the VA) about which forms to use for what.  We actually filed one appeal on Form 1,  got a letter back saying to use Form 2, sent Form 2, and then got a letter saying to use Form 1!  So, don't be surprised if you file an appeal under the AMA and you get a letter saying you filed on the wrong form. They may be right or they may not be right.
